Closed Escrow With Sellers Renting Back

Q: We recently closed escrow with a provision in our contract that grants the "sellers" the option to rent back for up to 60 days. We have been instructed by our agent to go through him for property visits and any issues or questions that we may have regarding the property. A few days ago we drove by and noticed that the front yard landscaping (plants and lawn) are not being watered and the lawn has not been mowed making it appear as if it is dying. This is raising concern on our part (the buyers) regarding our investment and how the entire property is being cared for?. What rights do we have since we are technically landlords of the property? We feel that since the close of escrow, our agent has changed his focus by not responding at all.

 

A: If your agent is not too responsive to your demands in contacting the renter and asking him to maintain the yard properly, then you should take the initiative in contacting the tenant and convey your concerns. If you are holding security deposit from the seller, then you can use that money to correct any damage that may occur while the tenant occupied the property. If no security deposit was withheld from the seller in escrow, you have no body to blame but your agent for not protecting your interest.
